The pleading itself takes issue with the fact that the apnea test was performed without consent of family, and alleges that the test itself may have *caused* brain damage that ultimately resulted in the declaration of death. But, there are several other interesting (IMHO) aspects to this story. If their own testing revealed that Israel still meets the medically-accepted USA standard for brain death, the hospital may have *already* advised the family of their intention to terminate futile medical care, and given them a timeline for doing so. Hospital social workers/case managers often help families do this if they're not yet familiar with the routine. Problem, is, this case is far from "typical." Because Israel is still legally considered deceased, there's no insurance to help pay for these services, and there's apparently not even a suitable *home* in which to provide it. They're still trying to either (1) raise the money for all those things, or (2) have the death certificate rescinded so that Israel will be eligible for Medicaid. Who knows if or when either of these things will *ever* happen. From what I've read about healthcare in Guatemala though, they have just one modern facility in Guatemala City and care in the rest of the country is pretty primitive. The hospital was intended to be a brief stopover on that journey, to allow that care to be arranged. <br /><br />Perhaps the hospital agreed to the transfer on that condition...somatic support would be provided for maybe a week or so, just to allow the family to make the arrangements for home care. But, as we've already recognized, the circumstances in this case don't make that easy. Now the family is depending on "donations" for all that, since neither private insurance nor Medicaid will pay for somatic support of a person declared legally dead. And, they want donations to secure a home close to their new doctor too! This is *not* something that will be accomplished in a week or two, if ever. So, the family has filed the restraining order for this "reprieve," to buy them more time to raise the hundreds of thousands of dollars they will need just to get started with this "home care" plan, and the hospital is stuck providing "care" indefinitely. If they get 24/7 nursing care why can't they both get jobs so they can buy their own house? They can work alternating shifts so one is home all of the time. First Ms. Snyder claims they have asked for a second opinion for a long time yet they had their second opinion. It was provided by Kaiser Roseville and even after refusing to accept that second opinion they asked for a third which the judge granted. They were never able to find another doctor willing to provide it so with time running out they flew to Guatemala.<br /><br />Now we find out that after getting a US hospital to agree to accept Israel they turn around and file restraining order against it. Talk about biting the hand that feeds you.
